RFID TERMS & CONDITIONS (PLAYPASS)

 

  1. The London Dessert Festival is a cashless Festival. You will only be able to pay for goods and services at the Festival using a tag embedded with an RFID chip attached to your LDF Sprinkles Smart Cart (and not using cash). You will also need the Card to access the Festival and certain areas within the festival.

 

  1. By purchasing a ticket to the Festival you accept the Festival operates as a cashless Festival using smart cards embedded with an RFID chip.

 

  1. Your LDF Sprinkles Smart Card will be operated by us via a platform provided by PlayPass (“Playpass”), having its registered offices at Lange Gasthuisstraat 29-31, 2000 Antwerpen, Belgium and trade registration number: 0501.728.738, and will be issued to you on entry into the Festival when you hand over a valid Ticket. If we grant you access to the Festival without a Ticket, we may issue you with a LDF Sprinkles Smart Card at our sole discretion.
    1. In order to use your LDF Sprinkles Smart Card to purchase goods or services at the Festival you must credit your LDF Sprinkles Smart Card with funds. You can credit your LDF Sprinkles Smart Card (which may hold a maximum balance of £500 at any time) using any of the following methods:
      1. online using a credit or debit card via the Website either before or during the Festival once you have created an online account (see paragraph 6 below), which will enable you to either: (i) make one off payment(s); or (ii) make use of the so-called “auto top up” function so that we can automatically credit your online account with a predetermined amount of either £10, £20, £30 or £40 (as selected by you) when you run out of funds on your LDF Sprinkles Smart Card. The use of this function at the Festival is subject to your being able to obtain sufficient Wi-Fi coverage;
      2. at the top up booths at the Festival using cash, debit card or credit card (minimum credit of £1).
      3. The only way to use cash (notes and coins) to add credit to your LDF Sprinkles Smart Card is by using the top up booths at the Festival. There is also a “card only” top up booth at the Festival, that is clearly marked as such.
      4. By creating an online account you will be able to register your Ticket/LDF Sprinkles Smart Card to your account and, amongst other things:
        1. credit your LDF Sprinkles Smart Card before and during the Festival without visiting the top up booths at the Festival;
        2. receive a refund, if applicable, of any unused credit on your LDF Sprinkles Smart Card after the Festival; and/or
        3. enable us to blacklist your LDF Sprinkles Smart Card if it is lost or stolen.

     

      1. Unless you create an online account and register your LDF Sprinkles Smart Card, we will not be able to blacklist your LDF Sprinkles Smart Card in accordance with paragraph 6 if it is lost or stolen.

     

      1. To create an online account you must visit the Website either before the Festival (in which case you will need to provide your name, your e-mail address and your Ticket number (barcode)) or during the Festival (in which case you will need to provide your LDF Sprinkles Smart Card identification number).

     

      1. You may ask for your online account to be de-activated by emailing support@londondessertfestival.com. Playpass will use its discretion when considering your request and only delete your account if there is no unused credit on your LDF Sprinkles Smart Card and you have not linked your online account to a Ticket or LDF Sprinkles Smart Card.

     

      1. You must keep your LDF Sprinkles Smart Card in a secure location on your person at all times during the Festival.

     

      1. You will need to swipe your LDF Sprinkles Smart Card at access points and/or show your LDF Sprinkles Smart Card to the relevant Festival personnel in order to access certain areas of the Festival and to exit and enter the Festival. Access to such areas and the Festival will be subject to the terms of your Ticket and such other terms as are applicable to that area and/or the Festival.

     

      1. You can purchase goods and/or services from vendors at the Festival by touching your LDF Sprinkles Smart Card on a LDF Sprinkles Smart Card reader located at the point of purchase, provided that you have enough credit on your LDF Sprinkles Smart Card to pay for the entire transaction or have elected to make use of the auto top up function. You may not use the credit on your LDF Sprinkles Smart Card for any other purpose. The available balance on your LDF Sprinkles Smart Card will be reduced by the full amount of each transaction.

     

      1. Once you have authorised a payment using your LDF Sprinkles Smart Card, neither we nor Playpass can change or cancel it or provide you with a refund. Refunds for goods or services purchased from a Festival vendor may be processed by that vendor but will be subject to the terms of your agreement with that vendor.
      2. Neither we, nor Playpass are party to any contract between you and a vendor at the Festival and neither we nor Playpass shall be liable for, or in connection with, any goods or services provided or not provided by any such vendor.

     

      1. The credit in your LDF Sprinkles Smart Card may only be used by you (as the registered account holder). You may not use any LDF Sprinkles Smart Card other than the LDF Sprinkles Smart Card associated with your Ticket number.

     

      1. Your LDF Sprinkles Smart Card is not a credit card, debit card, charge card, or cheque guarantee card and the balance on your LDF Sprinkles Smart Card will not earn interest.

     

      1. You may obtain a refund of any credit remaining on your LDF Sprinkles Smart Card (excluding any free credits relating to auto top up or given by authorised person) either via the online refund portal, subject to payment of a £1 administration fee

     

      1. In order to obtain an online refund you must register your bank account details via the refund portal and the refund will be paid to that bank account. It is your responsibility to ensure that the correct bank account details are registered during the refund request process on or before 19th September 2019.       1. If there is any credit remaining on your LDF Sprinkles Smart Card and you do not wish to obtain a refund or only wish to obtain a partial refund and/or if you are not eligible for a refund, you will be given the option to carry such remaining credit forward for use by you in relation to the purchase of a Ticket for the following year’s Festival, in which case we will send you a discount code for use on or before 30th September 2019. The discount code may only be used in relation to the purchase of a Ticket for the following year’s Festival and will expire on 14th October 2019. If the code is unused after this date the monetary value of the code (selected as part of your online refund process) becomes the property of the Festival. Refunds will be paid in accordance with this paragraph as soon as reasonably practicable after the Festival, provided that you have taken the steps specified in paragraphs 17 – 20 and if:
        1. neither we nor Playpass have any reason to suspect that you have been engaged in fraudulent activity or breached these Conditions; and
        2. neither we nor Playpass are prohibited by any applicable law, regulation, court order or instruction or guidance of a competent regulatory authority.

     

      1. If you have not requested a refund or taken any action on your outstanding LDF Sprinkles Smart Card credit from the 2019 Festival, as specified in paragraphs 17 – 20, on or before 19th September, you will not be entitled to a refund and any credit remaining on your LDF Sprinkles Smart Card will become the property of the Festival.

     

      1. Neither we nor Playpass accept any liability for any loss or damage which is caused to you or any third party as a result of a LDF Sprinkles Smart Card which is lost or stolen or used without permission.

     

    1. If your Ticket is replaced for any reason before you receive a LDF Sprinkles Smart Card linked to that Ticket, any credit on that Ticket will not be transferred to the replacement Ticket and you will only be able to claim a refund of that credit after the Festival. Such refund will be paid in accordance with paragraphs 17 – 19.

 

    1. You should treat your LDF Sprinkles Smart Card as if it were cash in your wallet. If you lose your LDF Sprinkles Smart Card then any credit which is stored on your LDF Sprinkles Smart Card account may be lost, as if you had lost your wallet.

 

    1. You shall at all times remain responsible for the use of your LDF Sprinkles Smart Card and the activity on your online account, whether or not the activity was authorised by you.

 

    1. You may not tamper with your LDF Sprinkles Smart Card. If we or Playpass reasonably believe you have tampered with your LDF Sprinkles Smart Card, we reserve the right to disable your LDF Sprinkles Smart Card and/or reject you from the Festival.

 

    1. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

 

    1. We have the right to disable any LDF Sprinkles Smart Card, user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of these Conditions.

 

    1. You must immediately notify a member of staff at one of the service points at the Festival if your LDF Sprinkles Smart Card is lost, stolen, damaged or if you know or suspect that anyone has used the credit on your LDF Sprinkles Smart Card or knows your user identification code or password and provide your account username (if you have created an online account) and any other information reasonably required to verify your identity or deactivate, suspend, or cancel your LDF Sprinkles Smart Card.
    2. If, in our reasonable opinion, a LDF Sprinkles Smart Card is damaged (other than through tampering), lost, stolen or destroyed, a replacement tag shall be issued as soon as reasonably practicable. Any replacement tag will be deemed to be a LDF Sprinkles Smart Card for the purposes of these Conditions.

 

    1. If you have registered your LDF Sprinkles Smart Card to your online account, we will attempt to blacklist your LDF Sprinkles Smart Card and you may be able to claim a refund of credit remaining on your LDF Sprinkles Smart Card after the Festival. Such refunds will be paid in accordance with paragraphs 17 – 19. If you have not registered your LDF Sprinkles Smart Card online, neither we nor Playpass will be able to blacklist your LDF Sprinkles Smart Card.

 

    1. Unless you return your original LDF Sprinkles Smart Card in working order to us when you request a replacement LDF Sprinkles Smart Card, the replacement LDF Sprinkles Smart Card will not be linked to your existing online account and you must provide a new email address to create an online account and register such replacement LDF Sprinkles Smart Card to that account.

 

    1. Any personal data which you provide to us from time to time in connection with your LDF Sprinkles Smart Card may be used by us and our partners, including, without limitation, Playpass and/or our payment service provider:
      1. to administer your LDF Sprinkles Smart Card account, process transactions, provide you with the assistance and services you request;
      2. to carry out our obligations arising from any contracts entered into between you and us; and
      3. to notify you about changes to our service, Website and/or the Festival.

 

    1. It is your responsibility to ensure that any information you provide to us is complete, accurate and that it remains up to date.

Without prejudice to any of our other rights, we may (without giving you prior notice) terminate our agreement with you, cancel or suspend your LDF Sprinkles Smart Card or online account, or refuse a transaction, if we or Playpass has reason to believe that the LDF Sprinkles Smart Card or online account is being used fraudulently, illegally, or in breach of these Conditions. In these circumstances we may refund any unused credit on your LDF Sprinkles Smart Card account at our discretion, provided that we act reasonably. Any refund, if given, will be processed in accordance with paragraphs 17 – 19.

 

Definitions

  1.  
    1. When used in these Conditions, the following terms shall have the following meanings:

 

“Conditions” means these terms and conditions, together with any amendments or updates to the same issued by or on our behalf from time to time;

“Festival” means the London Dessert Festival;

“Ticket” means any ticket (whether a hard copy ticket or an e-ticket) evidencing a personal revocable licence from us for an individual to attend the Festival and the Venue in accordance with the details indicated thereon and also to camp at the Venue;

“Ticket Holder” means any individual possessing, holding or using a Ticket, including (without limitation) the Ticket Purchaser or any person to whom the Ticket was issued or transferred;

“Ticket Purchaser” means the individual who has purchased a Ticket or Tickets through the Festival’s official ticket programme;

“us” or “we” means The London Dessert Festival Ltd. (company number 11783342);

“Venue” means the entire premises where the Festival is scheduled to take place at the Old Truman Brewery, 91 Brick Lane, Spitalfields, London E1 6QR including all adjacent and surrounding areas used or controlled by us in connection with the staging of the Festival, including without limitation any car park;

“Website” means www.londondessertfestival.com;

“LDF Sprinkles Smart Card” means any valid LDF Sprinkles Smart Card given to a Ticket Holder in exchange for their Ticket at the Festival.
