RFID BRACELET SERVICE BIME LIVE 2018
1. In general Last Tour with offices located in Ventosa Bidea Kalea, 46, 48013 Bilbo, Bizkaia. From now on the Promoter. All the visitors of the BIME Live, henceforth the Festival, will be provided with an interactive bracelet, which will give access and a set of services to the visitor (hereinafter "user") in the Festival, which will be held on days 26 & 27 October , 2018 in BEC!, Bizkaia.
Each of the interactive wristbands is equipped with a chip- RFID. With this chip and the corresponding RFID technology, it offers Festival visitors the possibility of obtaining the additional services detailed below, either independently or with third parties (hereinafter "RFID Services"):
- General RFID service
- Entrance to the festival
- Electronic payment service, charge with cash or credit card at the festival
- Optional RFID service
- Electronic payment service, Charge with credit card in web page
- Link to Facebook
In order to have access to the "Optional RFID Services", the attendee must register their entry through the "online registration service" of the Festival.
These General Conditions regulate the operation of the website service (url) and all its sub-pages (hereinafter "Website") hosting the "on-line registration service" of the entry. These General Conditions do not directly regulate the "RFID Services", but rather they are subject to the specific terms and conditions determined by the Promoter and / or third parties.
The term "Service" will be referred to below for the entire visit and / or use of the "Website" (which offers the "online registration service" of the bracelet)
With the use of the Service, the user acknowledges having read and accepted these General Conditions.
2. Content and availability of the Service.
The purpose of the Service is politically and religiously neutral, the Festival will try to avoid any type of discrimination in the broadest sense of the word.
The information provided to the Service is the result of in-depth research and analysis, however, the Festival does not guarantee the accuracy or integrity of said content, nor guarantees of any implicit or explicit type.
The Service may contain or refer to hyperlinks from other websites or third-party websites. The promoter does not have control of all the content or other characteristics of said websites or web pages, and the promoter likewise is not responsible for the content or characteristics of said websites or web pages. Even if the promoter adds a hyperlink to another website or website, it does not imply that the promoter agrees with the content of that website or website.
The user declares to have read and accepted the possibility that the promoter makes use of partners and external service providers to provide the hardware, software, networking, storage and related technology necessary for the proper functioning of the Service.
3. Use of the Service.
Only persons 18 years of age or older are authorized to use the Service
without supervision.

at least one of their parents or legal guardian. The Promoter is not
responsible for children under 18 who make use of the service without
control by one of their parents or legal guardian.
The use of this service is at the user's risk and account.
The Service is provided as and "as is" and "as available"
The user declares to have read and accepted the following:
The user does not have authorization to copy, duplicate, reproduce, sell,
resell or exploit any part of the Service, use of the Service or access to
the Service.
The user does not have authorization to use any method of data collection,
screen scraping, robots or similar methods of data collection or
extraction.
The user does not have authorization to upload or transmit computer
viruses, Trojans, worms or any other element of a destructive nature.
The user does not have authorization to modify, adapt, hack the Service or
modify any third party website to falsely imply that it is associated with
the Service.
The user does not have authorization to try or gather effectively and / or
use user names, passwords, e-mail addresses or other personal data of the
Service for any purpose.
The user may not use the Service for any illegal or unauthorized purpose.
The user may not violate any law with the use of the Service.
The promoter reserves the right to modify or temporarily or permanently
suspend the Service or part thereof, with or without notice and for any
reason at any time.
4. Creation of the account, registration of the entry and activation of the RFID Service
4.1. Where to validate the entrance?
In order to use the General RFID Services, the user must validate their
entry to the Festival.
You can validate the entrance to the Festival at the entrance of the

Once activated, the Account can be accessed at any time, using the email
account and password provided.
The account must be used by a single person. The account shared by several
people is not allowed. A person should not keep more than one account.
The user is solely responsible for all activity carried out under the
Account and to maintain the security thereof (including the e-mail and
password to access / connect). The user undertakes to inform the promoter
immediately of any unauthorized use. of the Account or any other security
problem.
The user is responsible for the disconnection of the account at the end of
each session. The promoter can not be and will not be responsible for any
loss or damage resulting from breach of security obligations.
4.3.2. Second step - Registration of the entrance.
For the registration of the entry it is necessary to provide some
personal information, at least Name and surnames, sex, year of birth, zip
code and country of residence.
In order to complete the registration of the entry, it is only necessary
to add the ticket number and click on the "ACTIVATE YOUR ENTRY" button.
The Data Protection Law and the Privacy Directive. The personal data
provided will be linked to the promoter's guest card and the smart

4.4. Activation of RFID Service.
Once the entry is registered successfully, the user can access the personal page "My Entry", where you can activate one or more of the aforementioned RFID services.
4.4.1. Electronic payment service, charge by credit card
The festival offers attendees who have registered their entrance to the Festival the possibility of paying with their smart wristband by charging it with a credit card. the purchase of certain products and services in the Festival venue (including but not limited to the purchase of food and beverages).
4.4.2. Electronic payment service and credit card connection.
The Festival offers attendees who have registered their entrance to the
Festival the possibility of paying with their smart wristband by linking
their credit card (with built-in RFID chip) to the purchase of certain
products and services in the Festival venue. not limited to the purchase
of food and drink).
If you want to use this "automatic recharge service", you must first
activate the service through the "My Entry" page and select the amount you
want for automatic recharge.
First of all it is necessary to select one or more "credit packs" to load
into the account.
Secondly, it is necessary to determine the maximum budget that you wish to
have at the Festival.
Once the previous steps have been completed, you will access a page where
you need to select the payment method. Depending on the payment method, it
will be agreed to comply with the requirements and particular conditions
determined by the payment provider (the direct contractual relationship
between the user and the payment provider governs).
After selecting the payment method, you will access a new page that
contains the "Automatic Billing Agreement" to accept if you wish to use
the electronic payment service and authorize the execution of future
automatic charges. The acceptance of this agreement generates a direct
contractual relationship between the user and Stripe, the platform
supplying the Festival's online payment gateway.
By clicking the "accept and continue" button, the electronic payment
service will be activated automatically. You will access the page "My
Ticket" finding an overview with the recharge / top-ups, drinks and
balance.
Upon arrival at the Festival, the "consumable" (= total amount of "top
ups" that can be spent) will be linked directly to the smart bracelet and
will be able to pay with it all products and services that accept this
electronic payment method.
At the closing of the festival, a refund of the unused "consumable" may be
obtained.
4.4.3. Link to Facebook.

The service can be activated by clicking on the "Facebook Link" button
within the "My Entry" page
It will be automatically transferred to the Facebook login page, where it
will suffice to enter the usual data to access. Once inside, the Facebook
link service will be activated automatically and will be redirected back
to the "My Entry" page.
This acknowledges having accepted and being solely responsible for
complying with the rules in accordance with Facebook's General Conditions,
service and privacy policy.
4.5. Deactivation of RFID Service.
In case of loss or theft of the bracelet there is the possibility of
detaching the user's wristband. Thus, the use of the bracelet as entry and
payment means is suspended.
The user's bracelet can be unlinked in:
- The Festival website.
- Designated area in the Festival.
5. Copyright and other intellectual property rights.
All texts, drawings, photographs, filmations, images, data, databases,
software, names, trademarks, logos and other elements of the Service are
protected by the right of intellectual property and belong to the promoter
or to third parties.
All databases of the Website are subject to the law of protection of
databases, both in structure and content.
The festival, its logo, graphics, button icons, scripts, and service names
are trademarks or trade names. They can not be used in relation to other
products or services that are not from the festival, in any way that could
be confusing or in any way that denigrates or discredits the festival. The
rest of the brands that do not belong to the festival, and have presence
or can have it on the Website are owned by their respective owners, who
need not be affiliated, connected or sponsored by the developer.
It is strictly prohibited to save, reproduce, modify, advertise,
distribute, transmit or sell information and content provided on or
through the Website.
6. Limitation of liability.
The user acknowledges and accepts that the Festival can not be and will
not be responsible for any direct, indirect, incidental, special,
consequential, punitive or exemplary damages, including but not limited to
damages for loss of income, goodwill, use, data or other intangible losses
(even if the Festival has been warned of the possibility of such losses)
resulting from:
- Malfunction, interruptions or errors in electronic shipments of services
or information through the Website.
- Viruses that could, despite the precautions taken, occur in the WebSite.
- Errors or negligence committed by employees of the Festival.
- Fraudulent falsification of data by third parties, due to unauthorized
intrusion into the Website.
- Actions or conduct of third parties on the Website.
- Inability to use the Service.
7. Alteration, access and unauthorized processing of user data.
For the use of RFID chips and their corresponding technology (including
technical support), XXX. hires PLAYPASS c.v.b.a., with registered offices
in 2018 Antwerp (Belgium). PLAYPSS c.v.b.a. it only operates as a
technical service provider, on behalf of the Festival account, which
remains fully responsible for the Service. PLAYPASS c.v.b.a. it is not a
part to be contracted between the user and the festival resulting from the
acceptance of these General Conditions.
8. Applicable legislation and Competent Court.
These General Conditions will be governed by the Law on Data Protection
(LOPD 15/1999 of December 13)
The parties agree that, in case of any dispute related to the Service
(including but not limited to these General Conditions), only the Spanish
Courts are competent.
